Terms of Service

Welcome to Futbolpals.com. These Terms of Service ("Terms") govern your access to and use of the Futbolpals.com website, platform, and related services (collectively, the "Service") operated by Futbolpals.com ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Beta Status

The Service is currently in beta testing. This means:

  • Features, functionality, user interfaces, and service availability may change, be modified, or be removed at any time without prior notice.
  • The Service may contain bugs, errors, or interruptions that could result in data loss or unexpected behavior.
  • Pricing, tier structures, feature limits, and included capabilities are subject to change at any time. Features currently available for free may become paid features, and vice versa.
  • We may reset, migrate, or delete data (including user accounts, event history, and statistics) as part of development or testing, though we will make reasonable efforts to notify users before doing so.
  • No service level agreements (SLAs), uptime guarantees, or support response commitments apply during the beta period.

By using the Service during the beta period, you acknowledge and accept these conditions and agree that we shall not be liable for any losses or damages arising from the beta nature of the Service. The beta period will end when we publicly announce the general availability of the Service.

2. Eligibility

To use the Free tier of the Service, you must be at least 16 years old. By creating an account, you represent and warrant that you meet this age requirement.

The Pro and Business tiers support organized youth activities such as kids' leagues and tournaments. Minors under 16 may participate in these tiers only with verifiable consent from a parent or legal guardian. The parent or guardian is responsible for the minor's use of the Service and agrees to these Terms on the minor's behalf.

3. Account Registration and Security

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your password and for all activity under your account.
  • You must notify us immediately at contact@futbolpals.com if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Description of Service

Futbolpals.com is a platform for organizing and managing pickup soccer games, leagues, and tournaments. The Service includes:

  • Event creation and management (one-time and recurring series).
  • Player invitations, RSVP tracking, and attendance management.
  • Team generation (random and AI-powered, on eligible tiers).
  • Game results recording and player statistics tracking.
  • Notifications via email and, where enabled, WhatsApp messaging.

We may add, modify, or discontinue features of the Service at any time without prior notice, except where such changes materially reduce the functionality available under a paid tier during an active subscription period.

5. Service Tiers and Pricing

The Service is offered in the following tiers:

  • Free (Individual): available at no cost with certain feature and usage limits.
  • Pro: a paid subscription with expanded features and higher limits (coming soon).
  • Business: a paid subscription for organizations with advanced management capabilities (coming soon).

Pricing for paid tiers will be published on the Service when available. We reserve the right to change pricing at any time with at least 30 days' notice to active subscribers. Feature limits for each tier are described on our pricing page and are subject to change.

6. User Content

"User Content" means any information, text, images, or other materials you submit, upload, or make available through the Service, including event descriptions, terms and conditions, avatars, and messages.

  • You retain all ownership rights in your User Content.
  • By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.
  • You represent that you have all necessary rights to submit your User Content and that it does not violate any third-party rights or applicable laws.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Harass, threaten, intimidate, or abuse other users.
  • Submit false, misleading, or fraudulent information.
  • Upload or transmit viruses, malware, or other harmful code.
  • Scrape, crawl, or use automated tools to extract data from the Service without our written consent.
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
  • Interfere with or disrupt the Service or its infrastructure.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service to send spam or unsolicited communications.

8. Termination

  • By you: you may delete your account at any time through your profile settings or by contacting us. Upon deletion, your personal data will be handled as described in our Privacy Policy.
  • By us: we may suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties.
  • Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect (including Sections 6, 9, 10, 11, 12, and 13).

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, DURING THE BETA PERIOD DESCRIBED IN SECTION 1, THE SERVICE IS EXPERIMENTAL IN NATURE. YOU EXPRESSLY ACKNOWLEDGE THAT THE SERVICE MAY CONTAIN DEFECTS, ERRORS, AND INCOMPLETE FEATURES, AND THAT USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content on the Service.

Futbolpals.com is a platform for organizing sports activities. We are not responsible for any injuries, damages, or losses that occur during events organized through the Service. Participants engage in physical activities at their own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUTBOLPALS.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OF OR INABILITY TO USE THE SERVICE;
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN;
  • ANY INTERRUPTION OR CESSATION OF THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  • ANY CONTENT OBTAINED FROM THE SERVICE; OR
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Futbolpals.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of the Service;
  • Your violation of these Terms;
  • Your violation of any third-party rights; or
  • Your User Content.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the State of Florida, and judgment on the award may be entered in any court of competent jurisdiction.

For users located in the European Union, this clause does not affect your rights under mandatory consumer protection legislation in your country of residence, and you retain the right to bring proceedings in the courts of your habitual residence.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. During the beta period, changes may take effect immediately upon posting. After the beta period ends, we will provide at least 30 days' notice for material changes through the Service (e.g., an in-app banner) or via email before the changes take effect.

When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

14. Miscellaneous

  • Entire agreement: these Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Futbolpals.com regarding the Service.
  • Severability: if any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: you may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
